1. Introduction and Acceptance
Welcome to Feedishy (“Feedishy”, “we”, “us”, or “our”). These Terms of Service (“Terms”) form a legally binding agreement between you and Feedishy, LLC regarding your access to and use of the Feedishy platform, including our website, mobile versions, and any related services (collectively, the “Platform”).
By creating an account, accessing, or using the Platform in any way, you: (a) confirm that you have read and understood these Terms and our Privacy Policy and Refund Policy; and (b) agree to be bound by them. If you do not agree to these Terms, you must not use the Platform.
Feedishy may update these Terms at any time. When we do, we will post the updated version on the Platform and update the “Last updated” date. Your continued use of the Platform after any changes means you accept the revised Terms.
2. Eligibility and Age Requirements
- The Platform is intended only for adults 18 years of age or older (or the age of majority in your jurisdiction, if higher).
- You may not create an account or use the Platform if you are under 18.
- By using the Platform, you represent and warrant that you are at least 18 years old, have legal capacity to enter into these Terms, and your use of the Platform does not violate applicable law.
3. Nature of the Service
Feedishy is an online marketplace and subscription platform that allows independent content creators (“Creators”) to publish and monetize digital content focused primarily on feedism, gainers, food-related and body-positivity themes (the “Content”), and allows users (“Fans”) to access such Content through subscriptions, one-time purchases, tips, and other paid interactions.
- Creators are independent users, not employees, partners, or agents of Feedishy.
- Creators are solely responsible for their Content, their interactions with Fans, and compliance with all laws that apply to them.
4. Account Registration and Security
- Provide accurate, current, and complete information during registration.
- Keep your login credentials confidential and do not share your account.
- Notify us immediately of any unauthorized use or security breach.
- Log out at the end of each session.
You are responsible for all activity that occurs under your account. Feedishy is not liable for any loss or damage arising from your failure to comply with these obligations.
We may close or suspend your account at any time, with or without notice, if we believe you have violated these Terms or applicable law.
5. Creators
To become a Creator, you may be required to submit identity verification documents, provide payout information (including tax information where applicable), and confirm that you own or control all rights to the Content you upload.
By registering as a Creator, you acknowledge that you are not an employee of Feedishy and are solely responsible for your own business, taxes, and compliance obligations.
Creators may upload and offer Content, set pricing, and manage subscriptions within the options provided on the Platform. Feedishy does not guarantee any specific earnings.
Platform Fee: Feedishy retains a platform fee of 25% of the gross amount paid by the Fan (before payment processor fees and taxes). The remaining 75% (minus applicable fees, chargebacks, refunds, and taxes) is allocated as earnings for the Creator.
6. Content Ownership and Licenses
Creators retain all intellectual property rights in their Content, subject to the license granted to Feedishy to host, store, display, distribute, and technically process Content in connection with operating and improving the Platform, including for security and moderation purposes.
Fans receive a limited, personal, non-transferable license to view purchased Content through the Platform for personal, non-commercial use only. Fans may not copy, redistribute, resell, or publicly display Content outside the Platform.
7. Content Standards and Prohibited Content
Feedishy is a niche adult platform focused on feedism, food enjoyment, and body-positivity. To comply with laws, payment-processor rules, and platform safety, the following rules apply.
You agree that all Content you upload involves only adults (18+) with informed consent, does not depict explicit sexual acts or full nudity, and does not violate third-party rights or applicable law. Feedishy may remove any Content at any time and may suspend or terminate accounts that violate these rules.
8. Fans: Purchases, Subscriptions, and Billing
Subscriptions may renew automatically until canceled before the renewal date. One-time purchases and tips are final and non-refundable except as outlined in our Refund Policy or where required by law. Prices are set by Creators and may be subject to taxes depending on the user’s location.
9. Payments and Payment Processors
Payments are processed by third-party processors such as Stripe and PayPal. Feedishy does not store full payment card numbers. Users authorize charges for amounts due, and acknowledge that processor fees, conversion rates, and dispute handling are controlled by third parties.
10. DMCA and Copyright Infringement
Feedishy respects intellectual property rights and responds to notices submitted under the U.S. DMCA. Copyright holders may submit takedown notices to our designated agent as described in our DMCA/Copyright Policy.
11. Disclaimers and Limitation of Liability
The Platform and Content are provided “as is” and “as available”. Feedishy disclaims warranties to the maximum extent permitted by law and limits liability as described in these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Disputes should first be addressed informally by contacting legal@feedishy.com. If unresolved, disputes may be subject to binding arbitration and a class-action waiver to the extent permitted by law.
